Sale terms and conditions

Preamble

The customer declares that he/she has read the following online shop terms and conditions before ordering the products.

It is the exclusive responsibility of each customer to define his/her needs, choose the appropriate equipment and softwares and ensure that the purchased products are compatible.

The placing of an order implies full and complete acceptance by the customer of these general terms of sale, as well as the full legal capacity enabling him/her to commit to these general terms of sale.

We may amend these general terms of sale at any time, subject to any such amendments being posted on our website.

1. Prices

The prices of our products are shown inclusive of taxes but excluding processing and shipping costs.
For all products shipped outside of the European Union and the French Overseas Territories, our prices are exclusive of taxes. Customs duties or other local taxes or import duties or State taxes are likely to be payable to the Administration of the country of destination. These duties and amounts do not fall within the jurisdiction of CDIP. They are always payable by the customer.

Promotional prices: Promotions are offered on our products for fixed periods. If several promotions are running on the same product at the same time, CDIP reserves the right to ensure that the customer benefits from the most advantageous promotion, since promotions are not cumulative.

CDIP reserves the right to amend its prices at any time but products shall be invoiced on the basis of the rates in force at the time when the order is recorded, subject to availability.

2. Order

Orders are placed by post, fax, email or online on the CDIP websites:

  • On the internet: www.cdip.com, www.studio-scrap.com or boutique.cdip.com
    receipt of orders placed on the website and paid by bank card will be acknowledged by email. It is the customer's responsibility to check the order confirmation and to alert CDIP immediately of any error.
  • By fax: +33 1 83 83 94 83.
    Print the purchase order completed online or on plain paper; the order will be processed upon receipt of payment.
  • By email: Send the purchase order to fr@cdip.com; the order will be processed upon receipt of payment.

Your order will be shipped upon receipt of your payment.

CDIP reserves the right to cancel or refuse any order from a customer with whom it has been in dispute over the payment of a previous order.

Invoices are enclosed within packages before shipping.

3. Validation

You declare that you have read and accepted these online shop terms and conditions before placing your order.
On our website, when you click on the 'Validate' button after the order process, you declare that you accept all the elements thereof as well as these general terms of sale, fully and without reservation.
The information recorded by CDIP constitutes proof of all transactions made by CDIP and its customers.
The information recorded by the payment system constitutes proof of all financial transactions.

4. Availability

Our product offers and prices are valid while they are visible on the website, while stocks last. If a product is unavailable after you have placed your order, we will inform you of this as soon as possible by email.

You will then be given the choice of:

  • Either canceling your order and being refunded
  • Or being issued with a credit note for an identical amount towards your next purchase
  • Or waiting for the product ordered to become available (in this case, a new delivery date be forwarded to you for information purposes only).

Reimbursements will be made exclusively by bank transfer or re-credit of bank card if the order comes from abroad, after deduction of the related bank charges.

5. Delivery

5.1 By post

The products are delivered to the delivery address provided by the customer upon ordering.
The delivery time includes time for preparation of the package and shipping time. Our usual carrier is La Poste; their delivery time is from 1 to 2 days for mainland France and Corsica. If you choose to pay by bank transfer, the order will only be processed upon receipt of this payment.

The customer is required to check the condition of the packaging and the conformity of the delivered product.

In the event of damage or missing items, the customer must refuse the delivery from the carrier and inform CDIP of any necessary observation.

CDIP may not be held responsible for consequences resulting from a delay in delivery.

5.2 By download

The products are delivered only as a download. When ordering, you must provide a valid email address. CDIP makes every effort to ensure that you receive the email containing your software license number as soon as possible, as well as the web link to follow in order to download the software.
If the CDIP's download server is temporarily unavailable, CDIP will do everything in its power to restore it.

The customer must ensure that his/her anti-spam tool does not block messages sent by our server.

The CDIP strongly advises the use of high-speed internet access for downloading purposes (ADSL, Wired…).
The CDIP may not be held responsible for consequences resulting from a delay in the routing of messages or files.

6. Shipping costs

Shipping costs include a contribution towards preparation and packing costs + postage costs. These are specified on the purchase orders for any place other than mainland France and Corsica.

Shipping costs are payable for each order placed.

7. Payment

You have various payment options:

  • - Either by bank card: Visa, Eurocard/MasterCard.
    The card is debited when the order is recorded.
  • Or by check, for any order over or equal to 5 Euros or equivalent.
    In the case of payment by check, it must be issued by a bank domiciled in mainland France and Corsica or in Monaco. The check must be sent, in an envelope with the correct postage, to:

And made payable to "CDIP".

  • Or by bank transfer.
    The related costs are always payable by the customer.
    Bank transfers must be made to the following account:

The products remain the property of CDIP until full payment of the purchase price, especially if the payment method is rejected.
Cash-on-delivery (COD) shipments will be accepted for shipment of an order in mainland France and Corsica, in return for an additional sum of 15 Euros, which will be added to the invoice.

8. Security

To guard against any risk of misappropriation of the customer's bank card, CDIP uses a secure payment system that adheres to SSL standards, the most secure and currently the most widespread encryption protocol.

All bank details are encrypted and routed towards the 'CyberMUT' web payment service of the Crédit Mutuel bank, without going via the CDIP website. CDIP never receives the bank authorization. It is managed directly by the bank.
CDIP does not keep any bank information.

9. Returns

9.1. Right of withdrawal

In accordance with the French law, the customer has a time limit of 7 (seven) working days to return, at their own expense, products with which they are not satisfied. This time limit runs from the day of delivery of the order.

Only those products sent back complete, in their original intact packaging, and in perfect resale condition will be accepted for return. Any product that is damaged or the original packaging of which is damaged will be neither reimbursed nor exchanged.

This right of withdrawal is exercised without penalty, the customer only paying the shipping and return costs.

The customer may request either reimbursement of the sums paid, or exchange of the product. In the event of an exchange, the shipping and return costs shall be paid by the customer.

The right of withdrawal may not be exercised any longer if the customer has requested his/her activation code.

9.2. Non-conformity of the products

Products that are faulty, damaged or do not conform to the order will be accepted for return, and reimbursed or exchanged, or will be the subject of a credit note. The return request must be made within 15 (fifteen) working days after delivery.

Before any return, the customer must draw up a detailed statement and send it to CDIP. Once agreed by CDIP, the customer must return the products to the address indicated to him/her.

10. Reimbursement procedure

In the event of a reimbursement or an order cancellation request, CDIP shall make every effort to reimburse the customer within a time limit of 30 days from receipt of the request.
Reimbursements will be made exclusively by bank transfer or re-credit of bank card if the order comes from abroad, after deduction of the related bank charges.

11. User license

The user must read the license before using the software. Requesting the activation code constitutes acceptance of the terms of the user license and cancels the right of withdrawal.

Purchasing a software package entitles the customer to use it on several computers solely for his/her personal use.
The customer may not authorize total or partial copying of the software to another user's computer.

The customer may only transfer the software user rights to another person subject to not using the software him/herself, transferring the original CD-ROM and the printed documentation and not keeping any copy, including a back-up copy or those installed on a computer. The beneficiary of the transfer must accept all the provisions of this license.

The customer must inform CDIP in writing and forward the beneficiary's details.

Obtaining an updated version, whether free of charge or in return for payment, or obtaining a new edition of the software at a preferential price as a result of this license does not authorize the customer to transfer any or all of his/her user rights in respect of any one of the versions or new editions of the software to another person.

12. Intellectual Property

All the text, comments, works, illustrations and images contained on the CD-ROM and on the packaging or reproduced on the CDIP websites are reserved under author's rights, under intellectual property and copyright and this applies to everyone.

This user license confers only one right of use for private use. Any other use, unless authorized beforehand by CDIP, constitutes infringement of copyright and will be prosecuted.

13. Responsibility

The products offered conform to current French legislation. CDIP may not be held responsible in the event of non-compliance with the legislation of the country where the products are delivered.

CDIP may not be held responsible for non-performance of the contract entered into in the event of stock out or unavailability of the product, force majeure, disturbance or all-out or partial strike - particularly of the postal services and carriers and/or communications - flood or fire.

Moreover, the CDIP may not pay any damages for any possible reason.

About the quality of printed documents, the CDIP will do its very best to produce documents that conform to the customers expectations. But, due to the subjective nature of the result's assesment and to the weight of the customers photos quality on the "look", please note that the CDIP will never proceed to reprint more than one set of ordered documents, and this within a $50 limit ; the amount calculated from the catalogues prices.

14. Applicable law - Disputes

In the event of a dispute, only the French version of this license will be taken into account.

Only French courts will be competent.

15. Identifiable information

CDIP undertakes not to disclose to third parties any information communicated by the customer.

CDIP only collects information strictly necessary for the proper processing of orders or for the purposes of informing the customer of any benefits, promotions and new products from which it would like its customers to benefit.

The information requested of the customer is necessary for the processing of his/her order and is used by CDIP departments. Pursuant to French legislation - law n° 78-17 of 6 January 1978 - the customer has a right to access information concerning him/her. Upon request, this information may be forwarded to the customer and, in the event of error or necessary amendments, rectified.
